SolGen Calida given five days to respond to Sereno’s appeal of SC decision nullifying her appointment as Chief Justice

The Supreme Court on Tuesday, June 5, gave Solicitor General Jose Calida five days to respond to Maria Lourdes Sereno’s motion for reconsideration of the High Court decision that nullified her appointment as Chief Justice.

It was Calida who filed the quo warranto petition that led to the landmark SC ruling on May 11.

During the en banc session, Associate Justice Noel Tijam, who was the ponente, was not present.

The SC may vote on Sereno’s MR on June 19.

Based on Section 7, Rule 56 of the Rules of Court, Sereno needs two votes in her favor for the SC ruling to be overturned.

The en banc had voted 8-6 in favor of the quo warranto petition.

If there is a tie, the SC’s first ruling will prevail over the second one.
