QC court junks illegal possession of firearms, explosives raps vs NDFP consultant Baylosis, his co-accused

(Eagle News)– A Quezon City court has junked the charges for illegal possession and firearms and explosives against National Democratic Front of the Philippines consultant Rafael Baylosis.

Quezon City Regional Trial Court Branch 100 Judge Editha Mina-Aguba also granted the demurrer to evidence filed by Baylosis’ co-accused, Roque Guillermo, after she found their arrest on Aurora Boulevard corner Katipunan Ave. in February last year was “illegal.”

As a result, the judge ruled the hand grenade, guns and ammunition from Baylosis and Guillermo the police said it confiscated from Baylosis and Guillermo at that time could not be used as evidence against them.

The confiscation of the items is also illegal as it was “not a product of a search incidental to a lawful arrest, or a stop and frisk search, or the plain view doctine,” the judge added.
