Malolos court dismisses Palparan’s bid to block his transfer to Bilibid

(Eagle News)–The Malolos Regional Trial Court Branch 15 has junked retired Army Maj. Gen. Jovito Palparan’s bid to block his transfer to the New Bilibid Prison.

The court dismissed Palparan’s motion to hold the implementation of the mittimus or commitment order, citing SC-OCA circular no.163-2013 which directs all trial court judges to cause the immediate transfer of convicted persons to the NBP, regardless of the pendency of a motion for reconsideration or an appeal.

Earlier, authorities said Palparan, who has been under military custody since his conviction for serious illegal detention and kidnapping of University of the Philippines students Sherlyn Cadapan and Karen Empeño, were slated to be transferred to the national penitentiary this week.

Guevarra said the target was to have him transferred on Thursday.

“I have personally discussed the matter with AFP Chief (Lt. Gen. Carlito) Galvez (Jr.), who has assured me that the (Armed Forces of the Philippines) custodial center will immediately comply, without prejudice to the resolution of any further judicial review,” Guevarra said.
