
(Eagle News)–A Manila court has junked the petition for writ of habeas corpus filed by the camp of Bryan Sy, owner of WellMed Dialysis Center accused of processing PhilHealth benefits of deceased patients.
In a three-page order, Branch 20 Judge Marivic Basili-Umali said the “singular function of a petition for habeas corpus” after all was “to inquire into the cause of detention of a person.”
“That there is no probable cause for the warrantless arrest of the subject has been held not a valid ground for the (issuance) of a writ of habeas corpus,” she said.
The judge’s order came after a hearing on the petition filed by Sy’s wife Therese Francesca Tan-Sy.
Sy’s camp had argued he had been illegally arrested as his case was not covered by a warrantless arrest.
Sy was arrested by the National Bureau of Investigation on Monday, June 10.
The NBI had said they would file estafa and falsification of documents charges against Sy in connection with the ghost dialysis mess.
The charges were filed on Tuesday, June 11.
Also charged were the two alleged whistleblowers of the scheme and other WellMed employees. Moira Encina
