JUST IN: Comelec 2nd division junks Eusebio election protest vs Pasig Mayor Vico Sotto

(Eagle News)–The second division of the Commission on Elections has ordered the dismissal of the election protest filed by former Pasig Mayor Robert Eusebio against now-Pasig Mayor Vico Sotto.

Comelec spokesperson James Jimenez said the second division cited the “insufficiency in form and substance “of  the election protest in its unanimous decision.

“It failed to reflect a detailed specification of the acts or omissions complained of showing the electoral frauds, anomalies, or irregularities in the protested precincts,” Jimenez quoted the decision as saying.

Sotto, who beat Eusebio in the  Pasig mayoralty race in the May 2019 elections by over 80,000 votes,  had asked the Comelec to junk Eusebio’s electoral protest, saying it lacks a detailed specification of the acts or omissions complained of as required under Comelec Resolution No. 8804.

“The allegations are too broad and no evidence to support the claims other than the mere affidavits of the loser’s supporters,” Sotto’s lawyer, Romulo Macalintal, had said.

In his complaint, Eusebio had claimed votes from at least 29 clustered poll precincts were missing.
