CA junks NUPL’s petition for writs of habeas data, amparo

(Eagle News)–The Court of Appeals has junked the National Union of People’s Lawyers petition for a writ of amparo and habeas data.

In junking the petition filed with the Supreme Court on April 15, the appellate court’s former special fifteenth division said the group failed to prove the participation of military officials in what it said were perpetrated state attacks against them.

The SC, in a May 19 resolution, had ordered the appellate court to hear the petition and decide the case within ten days after it is submitted for decision.

The CA noted that where the writ of habeas data is concerned, the NUPL “failed to show how their right to privacy was violated given that their names, membership and particular position in or affiliation with NUPL, their photographs  and even the locations of their offices are already of public knowledge and readily accessible even to civilians…”

“While mere threats fall within the mantle of protection of the writs of amparo and habeas data, the alleged threats imputed against the respondents herein are not supported by substantial evidence, thus stand on nebulous grounds,” the CA said.

“Wherefore, the instant petition for writs of amparo and habeas data is denied,” the CA added.
