OSG: Trillanes may not have signed petition vs Proclamation No. 572 before notary public

The Office of the Solicitor General has asked two branches of the Makati Regional Trial Court to dismiss Senator Antonio Trillanes IV’s petition challenging Proclamation No. 572, and issue a warrant against him.

According to the comment filed by the OSG before branches 150 and 148, where Trillanes had been charged with coup d’etat and rebellion charges for the Oakwood mutiny and Peninsula Manila siege in 2003 and 2007, respectively, it appears Trillanes did not appear personally before a notary public to subscribe to his petition, as required by law.

“The Senate has no record of notary public Atty. Jorvino Angel going in and out of the Senate on Sept. 5, 2018, the date he supposedly swore to hid petition,” the OSG said, noting that Trillanes had been holed up in the Senate since Sept. 3, since news of the issuance of the proclamation broke out.

The OSG also noted a comparison of the documents notarized by Angel showed the signature there was different from the signature in Trillanes’ petition.

“Significantly, it was a female, not a male Atty. Jorvino, who signed an affidavit when one was presented to his office last Sept. 20,” the OSG said.

According to the OSG, Trillanes already admitted he had no application for amnesty in a Sept. 13 hearing in Branch 150.

The OSG also attached a news article in which Trillanes supposedly denied admission of guilt and admitted attaching an unaccompished application form only.

The OSG also attached the military’s certification there was no available copy of Trillanes’ application in their office.

“All these confirm the bases of President Rodrigo Roa Duterte when he declared the nullity of the grant of amnesty to Trillanes, the OSG said.
