Ombudsman opposes Napoles’ “preposterous” plea for custody transfer

She has a “misplaced, twisted sense of entitlement,” Ombudsman says

(Eagle News) — The Ombudsman has filed a written opposition to  Janet Lim Napoles’ urgent plea for a custody transfer to the Department of Justice, slamming the alleged pork barrel scam queen for having  a “misplaced and twisted sense of entitlement.”

According to the Ombudsman prosecutors, the request of Napoles, who is detained in Camp Bagong Diwa,  was “preposterous” given the fact that she still has to comply with other requirements before she can be given full coverage under the Witness Protection Program.

“Such circumstance alone does and cannot clothe her with all the privileges and treatment accorded by the WPP law and its implementing rules and regulations to a person regularly admitted under the program,” they said.

They added that in the first place, Napoles’ disclosure of her provisional acceptance to the program was a “serious breach of the confidentiality of her coverage which opens herself not only to penal sanction but also the termination of her provisional coverage.”

They said “the prosecution never entertained and does not entertain the idea of utilizing her as its witness…”

“Hence, the probability of her being discharged as a state witness under Section 17, Rule 119 of the Revised Rules on Criminal Procedure in this case is nil,” they said.

“Perched on her self-perceived pedestal, and believing that she is head and shoulder above the rest of the nameless and faceless detention prisoners, she now implores the Honorable court, via the instant motion, to treat her differently,” they added.

Napoles is facing plunder and graft cases in connection with the pork barrel scam before the Sandiganbayan.
