Prosecutors appeal Manila judge’s decision not to inhibit from Espinosa cases

(Eagle News) — The Department of Justice on Friday appealed a Manila judge’s decision not to inhibit from the illegal gun possession and illegal drug trafficking cases filed against Kerwin Espinosa.

Government prosecutors filed the motion for reconsideration of Manila RTC Branch 26 Presiding Judge Silvino Pampilo, Jr.’s decision in a hearing on Friday, April 4.

Pampilo had then said he would not inhibit as  he said the allegations of bias made against him were not backed up by evidence.

The prosecutors had sought his inhibition after he allowed one witness to recant his testimony.

But in their MR, prosecutors argued Pampilo’s actions were “a clear indication of bias.”

The charges filed against Espinosa were originally heard by Branch 14 of the Baybay, Leyte Regional Trial Court.

Citing security reasons though, the Supreme Court later ordered the case transfer to Metro Manila.
