Duterte orders Bello to submit inventory of companies involved in “labor-only contracting” within 30 days

(Eagle News) — President Rodrigo Duterte has ordered Labor Secretary Silvestre Bello III to submit an inventory of companies involved in “labor-only contracting.”

According to the memorandum shown to reporters on Friday, April 20, the “comprehensive report on the implementation of DOLE Department Order Nos 174 and 183 Is 2017, including violations thereof and a list of companies engaged and/or suspected to be engaged in labor-only contracting” should be submitted to the Office of the President within 30 days.

“Further the National Labor Relations Commission is directed to coordinate with the DOLE Secretary and submit a list of cases involving respondents found to be engaged in labor-only contracting and/or have committed violations of the above-stated Department Orders,” the memorandum signed by the President on April 17 said.

Earlier, Presidential Spokesperson Harry Roque said the President would no longer sign an executive order aimed at ending contractualization.

In a press conference on Friday, April 20, Roque said this would require an amendment to the Labor Code, which was in the purview of Congress.

He said the Labor Code allows for “service contracting” provided it was not “cabo.”

The omnibus rules to implement the Labor Code said that a cabo refers to “a person or group or persons or to a labor group which, in the guise of a labor organization, supplies workers to an employer, with or without any monetary or other consideration whether in the capacity of an agent of the employer or as an ostensible independent contractor.”

According to Roque, President Duterte’s promise was to end cabo and  “5-5-5,”  which refers to the illegal practice that sees employers  deliberately and repeatedly setting at five months — often with the aid of third party service providers –the term of service of a person to avoid his or her regularization.
