Citing “inordinate delay,” Ifugao Rep. Baguilat asks Sandiganbayan to junk graft case vs him

(Eagle News) — Ifugao Rep. Teodoro Baguilat Jr. has asked the Sandiganbayan to dismiss the graft case filed against him.

The case stems from his purchase of an allegedly overpriced second-hand vehicle—worth P900,000—when he was governor.

In seeking the dismissal of the case, Baguilat, in a seven-page motion filed before the fifth division, said there was an “inordinate delay” on the part of the Ombudsman in filing such, “thereby violating (his) Constitutional right.”

Baguilat noted that the Ombudsman only filed the case on Feb. 9, 2018, years after the crime supposedly took place, and took eight years to find probable cause.

“Accused Baguilat submits that the present case involves a single transaction, i.e. the alleged irregularity in the procurement of a second-hand Isuzu Trooper Wagon, which certainly did not involve complicated factual or legal issues as would justify a delay of almost eight years in terminating the preliminary investigation,” he said.
